Nghỉ thai sản được hưởng lương như thế nào?

Chào luật sư! cho tôi hỏi tôi nghỉ thai sản theo luật lao dộng mới quy định được nghỉ 6 tháng. Như vậy bảo hiểm sẽ tính lương tôi như thế nào ?

Theo Điều 34, 35 Luật Bảo hiểm xã hội, lao động nữ hưởng 100% mức bình quân tiền lương, tiền công tháng đóng bảo hiểm xã hội của 6 tháng liền kề trước khi nghỉ thai sản; được bảo hiểm y tế trả 80% chi phí sinh nở.

Ngày 18/6, Quốc hội đã thông qua Bộ luật Lao động năm 2012 thay thế cho Bộ luật Lao động năm 1995. Bộ luật Lao động năm 2012 có hiệu lực thi hành từ ngày 1/5/2013. Một trong các điểm mới của luật này là thời gian nghỉ thai sản của lao động nữ. Theo đó, thời gian nghỉ thai sản của lao động nữ được tăng lên từ 4 tháng thành 6 tháng. Toàn bộ thời gian nghỉ thai sản được bảo hiểm xã hội chi trả.

Đối với trường hợp sinh con trước ngày Bộ luật Lao động năm 2012 có hiệu lực, mà đến ngày 1/5/2013 vẫn đang trong thời gian nghỉ sinh con theo luật cũ (4 tháng), theo quy định tại Điều 240 Bộ luật lao động năm 2012, người lao động sẽ được nghỉ thêm 2 tháng và 2 tháng nghỉ thêm này cũng được bảo hiểm xã hội chi trả như đối với các trường hợp sinh con sau ngày 1/5/2013.

Việc tăng thêm thời gian nghỉ thai sản cho lao động nữ đã được luật quy định, do vậy mọi cơ quan, tổ chức, cá nhân sử dụng lao động phải nghiêm chỉnh chấp hành quy định này. Tuy nhiên, cũng có thể có trường hợp người sử dụng lao động không biết hoặc biết nhưng cố tình không thực hiện. Do vậy, trường hợp người lao động không được người sử dụng lao động cho nghỉ đủ 6 tháng có quyền khiếu nại đến người sử dụng lao động hoặc đề nghị tổ chức công đoàn (nếu có) hoặc phòng lao động thương binh và xã hội quận, huyện có biện pháp yêu cầu người sử dụng lao động thực hiện đúng quy định của pháp luật.

Về mức hưởng chế độ thai sản, theo quy định tại Điều 34, 35 Luật Bảo hiểm xã hội, lao động nữ được 100% mức bình quân tiền lương, tiền công tháng đóng bảo hiểm xã hội của 6 tháng liền kề trước khi nghỉ việc.

Ngoài ra, người lao động nữ còn được trợ cấp một lần khi sinh con bằng hai tháng lương tối thiểu chung.

Đối với chi phí khám chữa bệnh, sinh con theo quy định tại Điểu 22 Luật bảo hiểm y tế, người lao động được bảo hiểm y tế chi trả 80% chi phí và họ phải chịu 20% chi phí.
